Understanding the functioning of a Syndic in Mauritius of co-ownership
To fully understand our missions, it is important to understand how co-ownership works:
First of all, all the co-owners get together to form the Mauritius syndicate of co-owners. The latter collectively decides on the management, works and budget of the co-ownership. These decisions are taken by the co-owners at the General Assemblies which take place at least once a year.
The Syndicat Maurice des Copropriétaires entrusts the day-to-day and financial management to a Syndic Maurice de Copropriété whom it appoints and mandates at the General Meeting.
The Syndic Mauritius, Comagim in our case, then becomes the executive body in charge of the administration of the co-ownership. He executes the decisions taken at the General Meeting, carries out the work necessary for the maintenance and safety of the building, draws up the budget, organises the General Meetings and carries out all the tasks described in the chapter entitled “Our services”.
It should also be noted that during the General Meeting, the co-owners elect their “Conseil Syndical Mauritius”: a group of voluntary co-owners whose mission is to assist and control the syndic in his technical and financial management.
In the context of a contract that clearly defines the role of the trustee Mauritius, a contract that distinguishes between :
- Current management services, subject to an annual flat rate negotiated with the Syndical Mauritius Council ;
- Particular services, subject to pricing by the session or as a percentage of the amount of the work ;
- Refunds of expenses ;
